Freedom to Operate Analyses

Freedom to operate analysis addresses the question of whether you are free to produce your product or engage in your proposed activity without infringing on someone else's patent. The process typically involves a search to identify relevant patents, followed by an examination of the claims in those patents to determine whether they conflict with yours.

This analysis identifies the intellectual property risks and potential costs of a project and helps determine whether to continue with the project, whether any changes should be made, and whether a license should be requested for pertinent patents.

A freedom to operate analysis may be desirable at the beginning of a project or when a project changes direction or expands into a new area.
